FIELD OF APPLICATION / GENERAL
American Market, headquartered in Geneva "BLT SARL, Rue de Friborg 3 - 1201 Geneva Switzerland (hereinafter "American Market"), operates an online Market.
The proposed offer is aimed at private adults and legal entities domiciled in Switzerland or in the European zone.
These general conditions of sale (hereinafter "GTC") govern the entire purchase procedure in the Online Market, in particular the registration of customers, the registration and use of data concerning them, orders, deliveries, payments, customer service, complaints.
The use of customer data is governed by the data protection declaration. Express reference is made to said declaration, which forms an integral part of these GTC.
REGISTRATION
Registration to the online Market is exclusively reserved for persons having the exercise of their civil rights. In order to be able to place an order, the customer must identify himself with his e-mail address and password in the Online Market.
If this is his first order and he does not yet have an online account, the customer will be asked to create a user account and enter the data required for registration. These must be complete and truthful. The customer is required to update his data himself. Registration is free. It is not equivalent to a right of access to the online Market.
The customer undertakes to protect his account and not to transmit to third parties the password he uses to connect.
An information e-mail on new products or special promotions may be sent several times a year to the e-mail address indicated during registration. The customer can unsubscribe at any time by clicking on the link located at the bottom of the email.
ORDER
Placing an order :
Orders in the Online Market are made exclusively online.
Assortment and product information:
The assortment as well as the price of the products of the American Market online may differ from that offered by the American Market in its physical points of sale and may also vary from one region to another depending on the place of delivery.
American Market strives to provide accurate product information. Product descriptions published in the Online Market are updated regularly and with the utmost care. In exceptional cases, these descriptions may not match the information on the product packaging. In this case, the information on the packaging is authentic. Before using the product, the customer should always consult the specific information regarding allergies, intolerances, diabetes, etc. listed on the packaging.
American Market does not sell alcohol to young people under the age of 18. By ordering spirits, the customer agrees to ensure that the delivery is received by an adult, both for a delivery by delivery person and for a deposit in front of the door.
American Market has the exclusive right to use all of its product descriptions, photos, texts, etc.
American Market reserves the right to generally limit the deliverable quantity of certain products, or even not to deliver a given product. An additional limitation may be applied to the above quantities in the case of shares.
Sending the order / conclusion of the contract:
Once the online ordering procedure has been finalized by clicking on the validation button "Place the order", the order is final and can no longer be modified. Furthermore, by clicking on this button, the customer confirms the accuracy of all the information he has provided and submits to American Market a binding purchase offer for the products he has ordered. Shortly after having finalized the order procedure, he receives by email from American Market a confirmation of receipt of the order, which constitutes acceptance of the purchase offer by American Market. Only this confirmation validates the establishment of a contractual relationship between the client and American Market.
Deliveries are made by the Swiss Post service.
American Market reserves the right to cancel orders. The customer is, in this case, informed by email before the delivery of the goods.
Data Transfer Warranty:
In the current state of technology, it is not possible to guarantee that data transfer via the Internet will work error-free and/or permanently. American Market is not liable for the permanent and uninterrupted availability of the online Market, nor for technical and electronic errors that may occur during the ordering process. In particular, it cannot be held responsible for delays in processing or accepting orders.
DELIVERY
Delivery of ordered products:

By finalizing the order procedure in the online Market, the customer accepts that in case of absence, his order is simply deposited at the post office.
The use of the goods and the risks, in particular of theft or damage by third parties or bad weather, are transferred to the customer as soon as the order has been delivered or deposited.
American Market and partner delivery services make every effort to meet delivery deadlines. However, delivery times are given for information only. Non-compliance with delivery times by American Market or by a partner service does not give the customer the right to claim damages or to cancel his contractual order. The customer is not entitled to any compensation.
Impossibility of delivery:
If American Market or the delivery partner is unable to deliver an order confirmed by American Market, American Market is not obligated to provide delivery by any other means. In this case, American Market cancels the order and informs the customer by email.
The customer is required to provide truthful information and to comply with the indications he has given. Should American Market otherwise be unable to deliver, e.g. ex. because the address indicated by the customer is incorrect or because the customer is absent but did not want his order to be simply deposited (in the case of delivery by the postal delivery service) , American Market is entitled to cancel the order and charge the customer a lump sum of CHF 50.00 for administrative costs.
Incomplete Deliveries:
American Market endeavors to deliver all the products ordered, respecting the quantities and in an irreproachable quality. In exceptional cases, however, it may happen that, for various reasons, a product is no longer available in the required quantities or that it cannot be delivered. American Market reserves the right to make incomplete deliveries in this case. The customer is informed by email before delivery of the goods.
Products that are not available at the time of delivery are neither delivered later nor replaced by other products. Only the products actually delivered appear on the final delivery note and on the invoice. In the event that a product appears on the final delivery note and on the invoice, but it has not been delivered, the customer will be reimbursed the sum corresponding to the price of the product.
An incomplete delivery can give rise neither to compensation in kind nor to damages.
Shipping cost :
The amount of the delivery costs is indicated at the time of the order. It varies according to the delivery method chosen, the amount of the order (after deduction of vouchers and discounts, if any) and the frequency of orders. For certain assortments and delivery methods, the minimum amount per order is CHF 60.

Delivery notes and invoices are sent electronically.
PRICE AND PAYMENT
Price :
The assortments and prices do not necessarily correspond to those of the physical points of sale of American Market. There may be deviations, especially for products in action and special and other assortments.
All prices are in Swiss francs, including applicable VAT. The prices in force are always those indicated on the website of the Online Market at the time of the order.
The possible means of payment are indicated at the time of the order.
Important! When you finalize your order using your credit card, we do not charge you anything at that precise moment. Your card will only be charged on the day we finalize and send your order. Some products may be out of stock. If this were to be the case, we would only invoice you for the products delivered with the postage rate recalculated with the new weight.
The stocks offered in the Online Market do not fully correspond to the stocks offered in the physical outlets of American Market or in other sales channels.
CUSTOMER SERVICE AND COMPLAINTS

Any defects found must be reported immediately upon receipt of the goods. Failing this, the goods are considered to be faultless and accepted by the customer. Any hidden defect must be reported to customer service immediately after its discovery.
If the dispute is justified, the customer obtains a refund of the purchase price. The method of reimbursement depends on the means of payment used during the purchase. For certain means of payment, the customer receives the sum corresponding to the price of the product in the form of a gift card. This is the case when it is not possible to credit the refund to the payment method used during the purchase.
FINAL PROVISIONS
Contradictions between different language versions:
In the event of inaccuracies and/or contradictions between the German, French, Italian and/or English versions of these T&Cs, only the French version is authentic.
Modification of the T&Cs
American Market reserves the right to modify these T&Cs at any time. Any changes are communicated on the website of the Online Market and come into force as soon as they are put online. The customer declares to accept the new provisions from the first order following the posting of the new GCS.
Partial nullity clause:
If certain parts of these T&Cs prove to be inapplicable or void, the validity of the other provisions shall not be affected.
